Welcome to bookkenyasafaris.com. These Terms and Conditions (“Terms”) govern your relationship with Safaripin Tours and Travel Limited (“The Company,” “we,” “us”) and your use of our travel services.
By booking a trip with us, you agree to be bound by these Terms.
1. Booking and Contract
- 1.1 A booking is confirmed only when we have received your deposit and sent you a formal booking confirmation.
- 1.2 You must be at least 18 years of age to make a booking.
- 1.3 The person making the booking (the “Lead Guest”) accepts these terms on behalf of all persons named in the booking.
2. Payments
- 2.1 A deposit of 50% is required to secure your booking.
- 2.2 The balance must be paid 60 prior to the safari start date.
- 2.3 If the balance is not paid by the due date, we reserve the right to cancel your booking and apply the cancellation charges set out.
3. Cancellation and Refund Policy
If you wish to cancel your booking, the Lead Guest must notify us in writing via email. Cancellation charges are calculated based on the date we receive your written notification:
- More than 60 days before travel: Full Refund minus bank charges or 10% admin fee.
- 60 – 45 days before travel: 50% of total booking cost.
- 45 days or less before travel: 100% Non-Refundable. No refunds will be issued for cancellations made within 45 days of the travel date.
Note: Specific hotels or airlines may have stricter cancellation policies which will supersede the above. You will be advised of these at the time of booking.
4. Travel Insurance
- 4.1 Comprehensive travel insurance is mandatory for all clients traveling with Safaripin Tours and Travel Limited.
- 4.2 It is the client’s responsibility to ensure they have adequate insurance covering: medical expenses, personal injury, repatriation, loss of luggage, and cancellation/curtailment.
- 4.3 If you do not have travel insurance, you may request The Company to assist in arranging cover on your behalf for an additional fee. However, the ultimate responsibility for ensuring adequate coverage remains with you.
- 4.4 We accept no liability for any costs arising from your failure to secure adequate insurance cover.
5. Changes to Itinerary
- 5.1 We reserve the right to alter the itinerary due to unforeseen circumstances such as weather conditions, road conditions, or political situations (Force Majeure).
- 5.2 We will endeavor to provide suitable alternatives of comparable standards.
6. Passports, Visas, and Health
- 6.1 It is your responsibility to ensure that your passport is valid for at least 6 months beyond your travel date and that you have the necessary visas for Kenya.
- 6.2 You are responsible for complying with all health requirements (e.g., Yellow Fever vaccination, Malaria prophylaxis).
7. Liability
- 7.1 While we exercise due care in selecting third-party suppliers (hotels, airlines), we do not own or control these suppliers. We are not liable for their acts or omissions.
- 7.2 Safaris involve inherent risks (e.g., wild animals). By booking with us, you acknowledge these risks and agree that Safaripin Tours and Travel Limited is not liable for injury, death, or loss of property, except where such loss is caused by our direct negligence.
8. Governing Law
These Terms and Conditions are governed by the laws of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the Kenyan courts.
